Please read these terms carefully before using Jobkar. By accessing our platform, you agree to be bound by these terms — written in plain language, but legally binding.

Free service notice:Jobkar is currently free of charge for both job seekers and employers — no subscription, listing fee, or commission is charged today. We reserve the right to introduce optional paid features in the future, with at least 30 days' notice before any charge applies to you.

Agreement:These Terms & Conditions ("Terms") govern your access to and use of Jobkar's website, mobile application, and services operated by Jobkar Technologies ("Company", "we", "us", or "our") at jobkar.in. By creating an account or using our services, you agree to these Terms in full. If you do not agree, please do not access or use Jobkar.

1. Acceptance of Terms

By accessing or using the Jobkar platform — as a job seeker, an employer, or a visitor — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or a prominent notice on our platform, at least 15 days before they take effect where the change reduces your rights. Your continued use of Jobkar after any changes constitutes your acceptance of the revised Terms.

2. Eligibility

To use Jobkar, you must meet the following requirements:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction.
  • Have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
  • Not be prohibited from using our services under applicable Indian or foreign laws.
  • Provide accurate and truthful information during registration and while using the platform.

By using our platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify this and to suspend accounts that do not.

3. User Accounts

When you create an account on Jobkar, you are solely responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account, whether authorized by you or not.
  • Providing accurate, current, and complete information at all times.
  • Updating your information promptly when it changes.
  • Notifying us immediately at [email protected] of any unauthorized use of your account.

You may not share your account with others, create multiple accounts to mislead employers or job seekers, or use automated tools (bots, scrapers) to create or manage accounts. Violation may result in immediate account suspension or termination without refund of any paid features already used.

4. Our Services (Currently Free)

Jobkar provides a platform connecting job seekers with employers across India. As of the date of these Terms, all core features are free of charge for both job seekers and employers:

  • Job Search: Browse and apply for job listings from verified employers, at no cost.
  • Profile Creation: Create and manage a professional profile and resume, free of charge.
  • Job Posting: Employers can post job openings on Jobkar without any listing fee.
  • Messaging: Communicate directly with employers and recruiters through the platform.
  • Insights: Access general career trends, salary data, and industry insights we choose to publish.

We reserve the right to modify, suspend, discontinue, or introduce paid tiers for any part of our services at any time. If we introduce paid features in the future, participation will be optional, and existing free functionality will not be paywalled retroactively without clear notice.

5. User Conduct

You agree to use Jobkar only for lawful purposes and in a manner that does not infringe the rights of others, and in compliance with the Information Technology Act, 2000 and rules made thereunder. You must not:

  • Post false, misleading, fraudulent, or duplicate job listings or profiles.
  • Solicit payment, fees, or deposits from job seekers in exchange for interviews, offers, or job access of any kind — this is strictly prohibited and will result in immediate, permanent termination and may be reported to law enforcement.
  • Harass, abuse, threaten, defame, or discriminate against other users on any unlawful ground.
  • Scrape, crawl, mine, or extract data from our platform without our prior written permission.
  • Use our services to send spam, chain messages, or unsolicited commercial communications.
  • Attempt to gain unauthorized access to our systems, other user accounts, or non-public areas of the platform.
  • Upload malware, viruses, or any code intended to disrupt, damage, or gain unauthorized access to any system.
  • Impersonate any person, company, government body, or entity, or misrepresent your affiliation with one.
  • Violate any applicable Indian or international law or regulation while using the platform.

6. Job Postings & Employer Responsibility

Jobkar acts solely as an intermediary platform under the Information Technology Act, 2000, connecting job seekers and employers. We are not the employer, recruiter, or staffing agency for any position listed on Jobkar, and we are not a party to any employment relationship, offer, or contract formed between users.

  • Employers are solely responsible for the accuracy, legality, and completeness of their job listings, including salary, role description, and eligibility criteria.
  • Employers must comply with all applicable Indian labour laws, including but not limited to equal opportunity and anti-discrimination requirements, minimum wage laws, and the Shops and Establishments Act as applicable in their state.
  • Employers may not use Jobkar to advertise unlawful activity, multi-level marketing schemes, or positions requiring upfront payment from candidates.
  • Jobkar reviews listings on a best-effort basis to catch obvious fraud, but does not guarantee that every listing has been independently verified for legal compliance before it goes live.
  • Job seekers are strongly advised to independently verify any employer, offer, or salary claim before sharing sensitive personal or financial information, or before making any payment of any kind — Jobkar will never ask you to pay to apply for or receive a job.

7. Content & Intellectual Property

All content on Jobkar — including our logo, name, text, graphics, software, and underlying data structures — is owned by or licensed to us and protected by applicable intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

By uploading content to Jobkar (such as your resume, profile photo, company logo, or job description), you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, store, display, and distribute that content solely for the purpose of operating and improving our services.

  • You retain full ownership of all content you submit.
  • You are solely responsible for ensuring you have the right to share any content you upload, and that it does not infringe any third party's rights.
  • We may remove or disable access to any content that violates these Terms, infringes intellectual property rights, or is unlawful, without prior notice.

8. No Guarantee of Employment

Jobkar is a discovery and connection tool — it does not guarantee that any job seeker will be hired, that any employer will find a suitable candidate, or that any listing, salary figure, or company detail displayed on the platform is current or accurate at the time you view it. Hiring decisions are made entirely by the employer, independently of Jobkar.

9. Indemnification

You agree to indemnify, defend, and hold harmless Jobkar, its founders, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • your use or misuse of the platform;
  • your violation of these Terms or any applicable law;
  • any content you submit, post, or share through Jobkar;
  • any dispute between you and another user, including any employment relationship, offer, or job posting; or
  • your violation of any third party's rights, including intellectual property or privacy rights.

This obligation survives termination of your account or these Terms.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without prior notice, if we believe you have violated these Terms, posted fraudulent content, or engaged in conduct harmful to other users or the platform.

You may delete your account at any time through your account settings. Upon termination, by us or by you:

  • Your access to the platform will be revoked.
  • Your public profile and listings will be removed from search results.
  • We may retain certain data as required by law, for legitimate business purposes, or as described in our Privacy Policy.
  • Sections of these Terms that by their nature should survive termination (including Indemnification, Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.

11. Disclaimers

Jobkar is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we do not warrant or guarantee:

  • That job listings, company information, or salary data are accurate, complete, or currently available.
  • That you will secure employment, or that any employer will secure a suitable hire, through our platform.
  • Uninterrupted, timely, secure, or error-free access to our services.
  • That any defects will be corrected, or that the platform is free of viruses or other harmful components.

Jobkar is a technology platform connecting job seekers and employers. We are not a recruitment agency, staffing firm, or employer of record, and we do not guarantee employment outcomes for any user.

12. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Jobkar and its founders, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or employment opportunity, arising from or related to your use of, or inability to use, our services — even if we have been advised of the possibility of such damages.

Because Jobkar is provided entirely free of charge as of the date of these Terms, our total aggregate liability to you for any and all claims arising from these Terms or your use of Jobkar shall not exceed ₹5,000 (five thousand rupees). If and when paid features are introduced, this cap will instead be the greater of the amount you paid us in the 12 months preceding the claim, or ₹5,000.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable Indian law, including liability for fraud or willful misconduct.

13. Force Majeure

We will not be liable for any delay or failure to perform our obligations resulting from causes beyond our reasonable control, including natural disasters, internet or telecommunications outages, government action, labour disputes, pandemics, or failures of third-party hosting or payment infrastructure.

14. Dispute Resolution

We encourage you to contact us first at [email protected] to resolve any dispute informally — most concerns can be resolved this way within a few days.

If a dispute cannot be resolved informally within 30 days, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement of the parties. The seat and venue of arbitration shall be Lucknow, Uttar Pradesh, India, and the proceedings shall be conducted in English. This clause does not prevent either party from seeking urgent injunctive relief from a competent court where necessary.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to Section 14 (Dispute Resolution), the courts at Lucknow, Uttar Pradesh, India shall have exclusive jurisdiction over any matter not resolved through arbitration.

16. Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer to address any complaints regarding content, conduct, or violations of these Terms.

17. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jobkar regarding your use of the platform, superseding any prior agreements.
  • Severability: If any provision of these Terms is found unenforceable by a court or arbitrator, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Relationship of Parties: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Jobkar.
